Terms and Conditions of WynLeads

Welcome to WynLeads! These Terms and Conditions (“Terms”) govern your access and use of the WynLeads CRM and AI-powered services (“Services”) operated by Brightwyn Private Limited (“Brightwyn Private Limited”, “we”, “our”, or “us”). By accessing or using WynLeads, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.

1. Definitions

• Brightwyn Private Limited, We, Our, Us refers to Brightwyn Private Limited, the legal entity operating the WynLeads CRM and related services.
• WynLeads refers to the CRM, AI, and related products and services offered by Brightwyn Private Limited.
• You, User refers to any individual, team, or company using WynLeads’s Services.
• Services refers to our CRM platform, AI transcription, call analysis, dashboards, and related features.

2. Eligibility

• You must be at least 18 years old to use WynLeads.
• By signing up, you confirm you have the authority to bind yourself or your organization to these Terms.

3. Account & Access

• Users must provide accurate registration information.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are liable for all activities under your account.

4. Use of Services

You agree not to:

1. Use WynLeads for unlawful, fraudulent, or harmful purposes.
2. Upload content without proper rights, licenses, or consent.
3. Reverse-engineer, copy, or modify WynLeads’s software or AI features.
4. Misuse or overload our APIs, servers, or integrations.

5. Call Recordings & AI Features

• By uploading or recording calls, you confirm you have obtained all required permissions and consents (e.g., from customers, prospects, or employees).
• AI transcriptions, summaries, and analyses are generated automatically and may contain inaccuracies.
• WynLeads provides these outputs for informational purposes only and is not responsible for errors, omissions, or business decisions based on them.

6. Subscription & Payments

• Our base CRM is currently priced at ₹299 per user/month (subject to change as updated on the Pricing page).
• AI features may have additional charges (bundled or usage-based) as specified at purchase.
• Payments are billed in advance, non-refundable, unless otherwise stated.
• Failure to pay may result in suspension or termination of your account.

7. Intellectual Property

• All rights, title, and interest in WynLeads’s software, branding, and AI features remain with us.
• Users retain ownership of their uploaded leads, contacts, and call data.
• By using our Services, you grant us a limited license to process your data solely for providing the Services.

8. Third-Party Services

• WynLeads integrates with APIs (e.g., OpenAI).
• We are not liable for availability, performance, or errors from third-party providers.
• Continued use of these integrations is at the user’s own risk.

9. Data Protection & Privacy

• Your use of WynLeads is subject to our Privacy Policy.
• We implement industry-standard safeguards to protect your data but cannot guarantee absolute security.

10. Termination

• We may suspend or terminate your account if you:
  
  • Breach these Terms.
  • Fail to pay subscription fees.
  • Misuse our Services.
• You may cancel your account anytime. Data will be deleted as per our Privacy Policy.

11. Limitation of Liability

• The Services are provided by Brightwyn Private Limited and WynLeads on an “as is” and “as available” basis, without any representations, guarantees, or warranties of any kind, whether express, implied, or statutory, including (without limitation) warranties of accuracy, completeness, performance, uptime, merchantability, fitness for a particular purpose, non-infringement, or that the Services will meet your requirements or be error-free, secure, or uninterrupted.
• To the maximum extent permitted by applicable law, Brightwyn Private Limited, WynLeads, and each of their respective affiliates, partners, directors, employees, agents, and contractors will not be liable for any indirect, consequential, exemplary, incidental, punitive, or special damages, or for any loss of profits, revenues, goodwill, opportunities, or data, or for business interruption, whether arising in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages.
• To the maximum extent permitted by applicable law, in no event shall the aggregate liability of Brightwyn Private Limited, WynLeads, and their affiliates, related to or arising from the Services, these Terms, or your use of or inability to use the Services, exceed the total fees (if any) actually paid by you to Brightwyn Private Limited for the WynLeads Services during the twelve (12) months immediately preceding the event giving rise to such claim. If you use the Services free of charge, our aggregate liability shall be limited to INR 1,000.
• Without limiting the generality of the foregoing, we do not assume liability for any unauthorized access to or use of your accounts, credentials, or data, any data loss, corruption, or disclosure, any interruptions, outages, delays, or failures of the Services or third-party providers, any force majeure events (including acts of God, natural disasters, internet failures, power outages, or governmental actions), or your failure to maintain appropriate backups, security controls, or compliance with applicable laws.

12. Indemnification

You agree to defend, indemnify, and hold harmless Brightwyn Private Limited, WynLeads, and their respective affiliates, partners, directors, employees, and agents from and against any and all claims, demands, actions, disputes, proceedings, losses, damages, liabilities, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your data or content; (b) your use of the Services; (c) your violation of these Terms, any other applicable terms, or any law or regulation; (d) your breach of any rights of a third party (including privacy, data protection, or intellectual property rights); and (e) any acts or omissions of your personnel, contractors, or end users.

13. Changes to Terms

We may update these Terms from time to time. Any material changes will be posted on our website or communicated via email or within the platform where reasonably practicable. Continued use of WynLeads after such changes indicates your acceptance of the updated Terms to the extent permitted by applicable law.
